Terms and Conditions of Participation in Competitions

Participation in online competitions and promotions and their conduct are governed by the following provisions. 
More detailed information on the organisation and conduct of current competitions, the prizes offered and winnings can be found directly on the relevant competition page. 

Terms and Conditions of Participation

The organiser of the competition is BEWITAL petfood GmbH & Co. KG (hereinafter referred to as the “Organiser”). 
Participation in online competitions, Facebook competitions or other promotions and their conduct are governed by the following provisions: 
If the competition is held on Facebook, the following applies: all information relating to this competition is provided exclusively by the Organiser and/or the prize sponsor. Facebook Ireland Limited, Hanover Reach, 5-7 Hanover Quay, Dublin 2, Ireland (“Facebook”) is in no way associated with this competition and does not sponsor, endorse or administer it. Therefore, no legal claims may be asserted against Facebook. 
§ 1 Competition 
(1) The duration of the competition (hereinafter referred to as the “Promotion Period”) is stated directly in the relevant competition. 
(2) If the competition mechanism differs from those described in § 4 (1) of these Terms and Conditions of Participation, the relevant mechanism, including the method of participation, will be described directly at the point of entry for the competition. 
If participation is possible via Facebook, participation in the competition shall take place as described in the relevant competition. 
a) either via the Facebook application (hereinafter referred to as the “Application”) on Facebook. This application linked to Facebook can be installed free of charge on the participant’s respective Facebook profile. After activating the “Like” button, the participant can enter the competition by answering the competition question; 
b) or directly on the Organiser’s Facebook page. In this case, the participant can enter the competition by a) answering the competition question in a comment under the competition post on the Facebook page; b) posting photographs/posts; c) marking the post with “Like”, etc. If the participant uploads photographs, videos or texts as part of a post and/or comment, the participant warrants to the Organiser that they are the lawful holder of the rights required for their use. 
The recorded time is decisive for determining the time of participation. Answers/posts/comments/“Likes” that were not submitted during the Promotion Period will not be taken into account. Neither the Organiser, Facebook nor the cooperating partners (as defined below) shall be liable for any delays in submitting or transmitting the answer and the participant’s data. 
(3) Prizes in the competition are provided by various partners (hereinafter referred to as the “Prize Sponsor”), meaning that the Organiser announces the prizes solely on behalf of the Prize Sponsor. This does not create any obligation on the part of the Organiser to provide its own performance unless, in a specific case, the Organiser itself is the Prize Sponsor. If the Organiser is not itself the Prize Sponsor, it acts as the promisor within the meaning of § 657 of the German Civil Code (BGB), and the relevant Prize Sponsor is therefore the sole party responsible for all claims relating to the prizes announced. 
§ 2 Participants 
(1) Unless otherwise stated, competitions are open to persons who have reached the age of 18. Persons under the age of 18 are excluded from participation. Prizes will not be awarded to minors who are expressly excluded from participation. 
(2) Participation in the competition and the awarding of prizes are restricted to participants who are permanently resident in Germany, Switzerland, Austria, Croatia, Spain, Italy, France, the Netherlands or the Czech Republic.
(3) The participant is solely responsible for the accuracy of the information provided when entering the competition (including the relevant information in the participant’s corresponding Facebook account). All personal information must be truthful. Otherwise, the participant may be excluded from the competition in accordance with § 3 (4). 
§ 3 Exclusion from the Competition 
(1) Employees and family members of employees of BEWITAL petfood GmbH & Co. KG and all its subsidiaries/affiliated companies, as well as participating service providers and Prize Sponsors, are excluded from participation. 
(2) In the event of a breach of these Terms and Conditions of Participation, the Organiser reserves the right to exclude the persons concerned from the competition and not to award them the prize or, where a prize has already been awarded, to subsequently revoke it and demand its return. 
(3) Persons who use unauthorised means or otherwise gain an advantage through manipulation will also be excluded. In such cases, prizes may also be subsequently revoked and reclaimed. 
(4) Anyone who provides false personal information will also be excluded. 
§ 4 Conduct and Administration of the Competition 
(1) The options for participation, rules of participation, method of selecting winners, etc. will be explained to the participant directly in the relevant competition form. 
(2) Winners will be notified after the end of the competition by email or directly via the relevant platform (e.g. Facebook, Instagram). The awarding of the prize will then be handled through direct contact between the winner and the Prize Sponsor in accordance with the conditions set out below regarding notification of the prize and expiry of the claim to the prize pursuant to §§ 4 and 5. 
Each winner must contact the Organiser within 4 weeks of receiving notification of the prize by private message (e.g. via Facebook, Instagram or email) and provide their real name. If the winner does not respond within this period, their claim to the prize will lapse. 
(3) The item presented as a prize in connection with the competition does not necessarily have to be completely identical to the item actually won. There may be differences, for example, in model, colour, etc. The Prize Sponsor reserves the right to select an item of comparable type and quality as the prize. 
(4) Non-cash prizes (with the exception of motor vehicles and travel) will be sent by the Prize Sponsor or a third party commissioned by it via a transport company, parcel service or post to the postal address provided by the winner. Delivery within the Federal Republic of Germany is free of charge. All other shipping costs and customs duties shall be borne by the winner. Despite the assumption of shipping costs, the place of performance remains the registered office of the Prize Sponsor. If delivery is made by a transport company, the company will contact the winner to arrange a delivery date. Delivery generally takes place from Monday to Friday between 8:00 a.m. and 6:00 p.m. The winner is also required to provide an alternative address in their immediate vicinity to which the prize can be delivered in their absence. If the transport company is unable to reach anyone either at the winner’s address or at the alternative address, it will leave a notification. The costs of repeat delivery shall be borne by the winner. 
(5) If it is not possible to award the prize or if it can only be awarded under unreasonable conditions, the winner will receive an equivalent substitute. An equivalent substitute will also be provided if the original prize is no longer available in the version presented (change of model, seasonal goods, etc.). 
(6) Cash payment of the prize or any substitute prize is not possible under any circumstances. 
(7) As a general rule, the claim to the prize or substitute prize may not be transferred. 
(8) Complaints concerning the conduct of the competition must be submitted to the Organiser in writing, specifying the relevant competition, within 14 days of the date on which the participant became aware of the reason for the complaint. Complaints submitted by telephone or after the deadline will not be processed. Questions, complaints and claims relating to prizes must be addressed exclusively to the relevant Prize Sponsor. 
§ 5 Expiry of the Claim to the Prize 
Unless otherwise stipulated in these Terms and Conditions of Participation, the winner is required to respond within four (4) weeks of the prize notification being sent. Otherwise, the claim to the prize will lapse. The claim to the prize will also lapse if the prize cannot be awarded for reasons attributable to the winner within four (4) weeks of the first notification of the prize. Different deadlines apply to prizes consisting of motor vehicles and travel, as specified in § 4 (5) and (6), respectively, as set out below. 
§ 6 Premature Termination of the Competition 
The Organiser reserves the right to interrupt or terminate the competition at any time without prior notice and without stating reasons. This option will be exercised in particular if the proper conduct of the competition cannot be ensured for technical reasons (e.g. viruses in the computer system, manipulation or hardware and/or software errors) or for legal reasons. If such termination is caused by the actions of a participant, the Organiser may claim compensation from that person for any resulting damage. 
§ 7 Data Protection 
(1) Participation in the competition requires registration via the competition form and the provision of various information (hereinafter also referred to as “Registration Data”). For other competitions, participation may be possible via an already registered participant account. 
(2) There is no legal entitlement to register for or participate in the competition. 
(3) The Organiser processes the data provided by the participant during registration for the duration of the competition for the purpose of conducting and administering the competition and, for this purpose, forwards it to the relevant Prize Sponsor or an agency working for the Prize Sponsor. The participant further agrees that the submitted data and photographs may be forwarded to the importer or wholesaler in a country participating in the competition for the purposes of further promoting the competition and announcing the winners. By participating in the competition, the participant gives their consent. The legal basis for processing is Art. 6(1)(a) GDPR. Consent may be withdrawn from the Organiser at any time without stating reasons. Participation in the competition will then no longer be possible. 
(4) All personal data of participants is processed and used by the Organiser in accordance with applicable legal provisions. The Organiser has appointed a Data Protection Officer who can be contacted at datenschutz@bewital.de. 
(5) Data subject rights (the right of access, rectification, erasure, restriction of processing and objection) may be exercised against the Organiser or its Data Protection Officer. The participant also has the right to lodge a complaint with the competent data protection supervisory authority. 
(6) The participant grants the Organiser, free of charge, the following rights: non-exclusive and irrevocable rights, unlimited in terms of territory, time and content, to use and exploit the uploaded image, in particular the right to publish it on the BELCANDO® and LEONARDO® brand and fan websites, on Facebook, Instagram, Pinterest, on fan trucks and in other printed materials of the BEWITAL Group. 
§ 8 Withdrawal of Consent 
The participant may at any time request the deletion of their Registration Data and thereby withdraw from participation by sending a withdrawal request to info@bewital-petfood.de. 
§ 9 Liability 
(1) Upon fulfilment or awarding of the prize, the Organiser is released from all obligations unless these provisions specify an earlier point in time. 
(2) Claims arising from any material and/or legal defects in prizes provided by Prize Sponsors must be asserted exclusively against those Prize Sponsors. 
(3) The Organiser shall not be liable for the insolvency of a Prize Sponsor or for any consequences arising from it in relation to the conduct of the competition. 
(4) The Organiser shall only be liable for damage caused intentionally or through gross negligence. In the event of culpable injury to the life, body or health of a natural person, the Organiser shall also be liable in cases of ordinary negligence. The Organiser shall furthermore be liable for ordinary negligence in the event of a breach of a material contractual obligation. Material obligations are obligations whose fulfilment enables the proper conduct of the competition and achievement of its contractual purpose and on whose compliance the participant may normally rely. The above limitation of liability applies in particular to damage resulting from errors, delays or interruptions in data transmission, faults in technical equipment or services, incorrect content, loss or deletion of data, viruses or otherwise arising from the use of the Application. Liability under the German Product Liability Act remains unaffected. 
(5) In the case of travel prizes, the Organiser shall furthermore not be liable for the consequences of a justified change to the travel offer or for the justified cancellation of the trip by the tour operator. Cash payment of the value of the trip is not possible. 
§ 10 Miscellaneous Provisions 
(1) Legal recourse is excluded. 
(2) The law of the Federal Republic of Germany shall apply exclusively. 
(3) If any of these provisions is or becomes invalid, this shall not affect the validity of the remaining Terms and Conditions of Participation. 
(4) The Organiser may amend these Terms and Conditions of Participation at any time without separate notification.
